By downloading, installing, or using the BinaryAddPesa mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, please do not use the App.
These Terms constitute a legally binding agreement between you and BinaryAddPesa. We reserve the right to update these Terms at any time, and your continued use constitutes acceptance of the revised Terms.
BinaryAddPesa provides the following services:
📲 Deriv Account Registration
We facilitate the creation of a Deriv trading account on your behalf through our affiliate partnership with Deriv (deriv.com). Your trading account is owned and operated by Deriv, not BinaryAddPesa.
💳 M-Pesa → Deriv Deposits
We enable you to fund your Deriv trading account by initiating an M-Pesa payment from your registered phone number. Funds are transferred to your Deriv account after successful M-Pesa confirmation.
🏦 Deriv → M-Pesa Withdrawals
We enable you to withdraw funds from your Deriv account to your M-Pesa number. Withdrawal processing times depend on Deriv's processing schedule and Safaricom's M-Pesa network.
⚠️ Important Disclaimer: BinaryAddPesa is NOT a financial institution, broker, or investment advisor. We are a technology intermediary that facilitates the connection between M-Pesa and Deriv. All trading activities occur exclusively on the Deriv platform and are governed by Deriv's Terms and Conditions.
To use BinaryAddPesa, you must:
- Be at least 18 years of age
- Have a valid and active M-Pesa account registered in your name
- Meet Deriv's eligibility requirements for account registration in your country
- Not be a resident of a country where online trading is prohibited
- Have the legal capacity to enter into a binding agreement
- Not have been previously banned from using BinaryAddPesa or Deriv
When creating an account, you agree to:
- Provide accurate, complete, and current information
- Keep your login credentials confidential and not share them with anyone
- Notify us immediately at support@binaryaddpesa.com if you suspect unauthorised access
- Accept responsibility for all activity that occurs under your account
- Complete any KYC (Know Your Customer) verification required by Deriv
We reserve the right to suspend or terminate accounts that provide false information or violate these Terms.
By using the deposit and withdrawal features, you acknowledge and agree to the following:
📥 Deposits (M-Pesa → Deriv)
- You authorise BinaryAddPesa to initiate an M-Pesa STK Push to your registered phone number
- Minimum and maximum deposit amounts are displayed in-app and may change
- Deposits are credited to your Deriv account after M-Pesa payment confirmation
- BinaryAddPesa is not liable for delays caused by M-Pesa network issues
📤 Withdrawals (Deriv → M-Pesa)
- Withdrawal requests are subject to Deriv's processing and approval
- Funds will be sent to the M-Pesa number registered on your account
- Processing times vary and are not guaranteed; typical time is 1–3 business days
- Withdrawals may be subject to Deriv's minimum withdrawal amounts
💰 Fees & Charges
- BinaryAddPesa may charge service fees on transactions; fees are disclosed before confirmation
- Safaricom may apply standard M-Pesa transaction charges
- Deriv may apply their own deposit/withdrawal fees
- We are not responsible for fees charged by third parties

You agree NOT to:
- Use the App for any unlawful purpose or in violation of any Kenyan or international law
- Attempt to launder money or finance illegal activities through the App
- Create multiple accounts or impersonate another person
- Reverse-engineer, decompile, or tamper with the App
- Use automated bots or scripts to interact with the App
- Attempt to gain unauthorised access to our systems or other users' accounts
- Exploit the App for fraudulent transactions or chargebacks
- Share your account or M-Pesa credentials with third parties
Violation of these rules may result in immediate account termination and referral to law enforcement authorities.
To the fullest extent permitted by law, BinaryAddPesa shall not be liable for:
- Trading losses incurred on the Deriv platform
- Delays or failures in M-Pesa transactions caused by Safaricom
- Delays or failures in Deriv account funding caused by Deriv's systems
- Loss of funds due to unauthorised access resulting from your failure to secure your account
- Interruption of service due to maintenance, technical issues, or force majeure events
- Any indirect, incidental, special, or consequential damages
Our total liability to you for any claim arising from these Terms or your use of the App shall not exceed the total fees paid by you to BinaryAddPesa in the 3 months preceding the claim.
Either party may terminate this agreement at any time:
- You may delete your account at any time through the App settings or by submitting a data deletion request
- We may suspend or terminate your account for violation of these Terms, suspicious activity, or regulatory requirements
- Upon termination, your access to the App will be revoked
- Financial transaction records will be retained as required by law (see Privacy Policy)
- Any pending transactions at the time of termination will be processed or refunded where possible
These Terms are governed by and construed in accordance with the laws of the Republic of Kenya, including but not limited to:
- The Kenya Data Protection Act, 2019
- The National Payment System Act
- The Consumer Protection Act, 2012
Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Nairobi, Kenya. We encourage resolving disputes amicably by contacting our support team first.
